  • DUI - Driving Under the Influence

DUI is not a DWI.  DUI applies when a person under 21 is caught driving with a detectable odor of alcohol on his person but is not considered legally intoxicated.  This is a class "C" misdemeanor.  However, it has much more serious consequences than most class "C" matters.  For example, your license can be suspended.  If convicted you will have to complete community service work and attend alcohol classes.

  • Public Intoxication

Public Intoxication is a class "C" misdemeanor.  You will be arrested for this offense.  This type of case is common in Austin due to the 6th street area and the college aged population.  Although it is punishable by only a fine, most people do not want to have a conviction and record for this type of matter.  Call us if you need representation for this type of case.  

  • Minor is Possession of Alcohol?

This is a class "C" misdemeanor.  You can be arrested for this offense, but will probably just receive a ticket.  This type of case is common in Austin due to the 6th street area and the college aged population.  Although it is punishable by only a fine, most people do not want to have a conviction and record for this type of matter.  Call us if you need representation for this type of case.  

  • Furnishing Alcohol to a Minor

This is a class "A" misdemeanor and you will be arrested for this offense.  It is commonly filed against clerks at convenience stores when they do not properly check identification of people purchasing alcohol. However, we also see this case frequently filed against young adults around college and university areas who purchased alcohol for their friends.

  • Possession of False Identification - FAKE ID

Although technically not an alcohol related offense, these types of cases seem to arise in connection with persons under 21 who are caught at bars or trying to purchase alcohol.  This type of case is very serious and can be filed as a felony or misdemeanor depending on the situation.  If you have been arrested and charged with this type of crime contact us immediately for an appointment.
