Fines & Penalties
Fines and Penalties can result from
imports that have been entered in violation of any Customs law or by false
or fraudulent acts. The amount of the penalty depends on the severity of
the violation, value of the goods, and the culpable degree of the
importer. In other words, an intentional act results in a more harsh
penalty than a negligent act. It is important to know that you do not have
to act intentionally to be subject to fines. An unintentional act can
result in fines and penalties. Returning passengers from abroad receive
fines as well as commercial importers.
Sometimes Customs will attempt
to forfeit the imported goods in addition to the fines levied. Passengers
and commercial importers are subject to forfeiture laws. Forfeiture laws
are quite complex, but we can assist you if you are dealing with this type
of problem.
Although each case is different
and many decisions must be made with each client, it may be possible to
contest Customs by filing a petition for relief. A petition is a legal
response to Customs actions such as fines, forfeiture, or penalties. CLick
